DMCA Policy

Disruptive Rain respects the intellectual property rights of others and expects our users to do the same. This policy outlines our procedures for responding to claims of copyright infringement under the Digital Millennium Copyright Act.

Our Commitment

Disruptive Rain complies with the provisions of the Digital Millennium Copyright Act applicable to Internet service providers (17 U.S.C. § 512). We respond expeditiously to claims of copyright infringement committed using our service.

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via our service, please notify our Copyright Agent as described below.

Filing a DMCA Notice

To file a DMCA takedown notice, you must provide written communication that includes substantially the following elements:

  1. 1A physical or electronic signature of the copyright owner or authorized agent
  2. 2Identification of the copyrighted work claimed to have been infringed
  3. 3Identification of the material claimed to be infringing, with enough detail to allow us to locate it
  4. 4Your contact information (address, telephone number, and email address)
  5. 5A statement that you have a good faith belief that use of the material is not authorized by the copyright owner
  6. 6A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner

Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages. If you are not sure whether material available online infringes your copyright, we suggest that you first contact an attorney.

Filing a Counter-Notice

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification. A valid counter-notice must include:

  1. 1Your physical or electronic signature
  2. 2Identification of the material that was removed and its location before removal
  3. 3A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
  4. 4Your name, address, and telephone number
  5. 5A statement consenting to the jurisdiction of the federal court in your district (or San Francisco, CA if outside the US)
  6. 6A statement that you will accept service of process from the person who filed the original DMCA notice

Upon receipt of a valid counter-notice, we will forward it to the original complaining party and inform them that we may restore the removed material in 10-14 business days. If the copyright owner does not bring legal action against you within that time, we may restore the material.

Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers.

We may also, at our sole discretion, limit access to our service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

We review all DMCA notices for completeness within 2 business days.

Take Action

If the notice is valid, we promptly remove or disable access to the allegedly infringing material.

Notify User

We notify the user who posted the material, providing a copy of the DMCA notice.

Counter-Notice Period

If we receive a valid counter-notice, we wait 10-14 business days before potentially restoring content.
